Most Bengaluru founders weigh a trademark application against two cheaper options. One is to keep trading on the name and rely on the reputation already built. The other is to assume the name cleared at incorporation is protected. The second is simply wrong: a name approved at ROC Bangalore clears the register of company names and settles nothing about your brand. The first is a genuine choice, and it loses for almost everyone. An unregistered user has to prove reputation, confusion and damage before a court will act. A registered proprietor opens with a certificate instead. If the name sits on packaging, on a delivery app, on a purchase order or on a test report, file it. If it is a working title you expect to drop by the next quarter, wait.
Who is filing a trademark from Bengaluru, and over what?
Trademark instructions here do not come from one kind of business. Four patterns repeat on our Bengaluru desk more than any others.
- An aerospace components and testing venture in Yelahanka, which needs one mark over a product family and a second over the testing work it sells to larger manufacturers.
- A restaurant and cloud kitchen brand whose Indiranagar counter opened first and whose Jayanagar counter followed, so one name now has to hold across two city corporations and several delivery platforms.
- A hardware or software company whose investors ask to see the intellectual property schedule before the term sheet is signed.
- A family trading house in Chickpet that has used the same name for two decades and has never filed a single application.
All four are already using the mark. That is the common thread, and it is why sequence matters more than most owners expect. Filing late still works. It just gets harder, because the register keeps filling up while you think about it.
What does a registered mark actually cover, and where does it stop?
A registration covers the mark as you filed it, for the goods or services you listed, in the classes you paid for, across the whole of India. A word mark protects the name in plain letters. A device mark protects the logo as drawn. Most Bengaluru brands end up needing both, because the word travels and the logo sells. The Nice system splits trade into 45 classes, goods in 1 to 34 and services in 35 to 45, and protection runs ten years and is renewable.
The limits surprise clients more often than the coverage does.
- A registration in one class gives you nothing in another, so the class list is a commercial decision and never a formality.
- A purely descriptive word is not registrable however long you have used it, which is why so many food brands end up coining a name instead.
- Your domain is a contract with a registrar and not a property right, and it will not stop a rival registering the same word as a mark.
- The artwork inside your logo is copyright, a different register with a different life, and plenty of brands need both.
- An Indian registration stops at the Indian border, so anyone selling abroad has to file abroad as well.

What does the filing cost, and how long does the whole run take?
Our Bengaluru engagement starts at ₹1,999 for the professional work. What moves the total afterwards is the number of classes and the applicant category you qualify under, so we confirm the statutory fee for your exact filing before anything is submitted. One brand in three classes is three applications, priced three times. That single decision changes the bill more than anything else on this page.
| Stage | What actually happens | Typical wait |
|---|---|---|
| Search and filing | Availability check, then the application goes in online | 1 to 2 days |
| Examination report | The Registry accepts the mark or raises objections | Months rather than weeks |
| Reply and hearing | Written response, and a hearing if the office fixes one | Weeks after the report |
| Journal publication | The window in which any third party may oppose | Four months |
| Certificate | Issued once the window closes or an opposition fails | Around 18 to 24 months from filing |
You are not waiting empty handed through any of that. The TM symbol is available from the day the application goes in, and that alone deters most casual copying.
How does a Bengaluru filing move, step by step?
- We search the IP India register for identical and deceptively similar marks in the classes you actually trade in, and give you a straight opinion before any money is spent.
- We draft the goods and services specification, because a careless specification is the most common reason a Bengaluru application picks up an avoidable objection.
- We collect the papers, which means a signed TM-48 power of attorney, identity proof for the applicant, the logo file for a device mark and dated evidence if you are claiming prior use.
- We file through IP India e-filing in the Chennai jurisdiction that covers Karnataka, and your application number reaches you the same day.
- We carry the prosecution, replying to the examination report, appearing at any hearing and watching the journal through the opposition window until the certificate issues.
Which registry office holds a Karnataka application?
Not one in this city. There is no trade marks office in Bengaluru at all. Karnataka is served by the Trade Marks Registry at Chennai, and every application from here is examined, heard and opposed there.
The test is not the office but the applicant. Territorial jurisdiction follows the principal place of business of the applicant in India, or the address for service in India stated in the application where there is none. That rule sits in the Trade Marks Act, 1999 and the Trade Marks Rules, 2017. So an applicant in Yelahanka, one in Whitefield and one in Jayanagar are in exactly the same registry territory. Which of the five Bengaluru city corporations your street falls in decides municipal questions, and has nothing to do with this.
The same map governs the rest of an intellectual property file. The Patent Office branch for Karnataka is at Chennai as well, and Karnataka design applications fall in the Chennai jurisdiction too. Copyright sits apart, with the Copyright Office at New Delhi. None of that is a travel problem: IP India runs e-filing and online status tracking, so filing, payment and tracking happen from your own desk. What the Chennai jurisdiction really decides is where hearings, show cause notices and opposition proceedings are held, and we appear in those for you.
What happens when an examiner objects, a rival opposes or a copycat appears?
Objections are normal rather than fatal. The examination report sets out the grounds, you file a written reply, and the office may fix a hearing. Most of the objections we answer for Bengaluru clients are about similarity to an earlier mark or a specification that claims far more than the business actually does. Both are arguable.
Opposition is a different animal. Once the mark is advertised, a third party has the four month window to file against it, and that turns into a small contested proceeding with a counter statement and evidence. Budget for it if your class is crowded.
Infringement is a court matter, and this is where a Bengaluru address begins to count. A suit over a copied mark goes to a dedicated commercial court at the district judge level, and Bengaluru Urban and Bengaluru Rural each have one. Those courts take a commercial dispute once its value clears the statutory threshold. Three lakh rupees is the floor set by the Commercial Courts Act, and a state is free to notify a higher one, so we confirm the current Karnataka position before advising on forum. The Karnataka High Court hears commercial matters on appeal rather than as a court of first instance, so a suit starts at the district level. The High Court itself sits at Bengaluru, and that is the seat to name in the jurisdiction clause of your licensing and franchise agreements.
