Design registration protects how a product looks, not how it works. A Chakan unit that has shaped a new housing for a component can file for it, and so can a brand with a bottle profile nobody else sells. If what is new is the mechanism inside, that is patent territory and a different application. The line is appearance against function, and it decides which queue you join. Everything below assumes appearance is what you want held.

What do you have to supply before we can file?
The application is short and unforgiving. The representations carry the whole case.
- Clear views of the article from front, back, top, bottom and both sides, consistent with each other
- The applicant name, address and nationality, matching what is already on record for the company or firm
- Identity proof where the applicant is an individual
- A power of attorney if we are to file in your name
- A priority document, only where an earlier foreign filing is being claimed
The address is not a formality. For trade marks the territorial jurisdiction of the Trade Marks Registry is determined on the basis of the principal place of business of the applicant in India. Where does a Pune application actually go, and who hears a copying dispute?

Unless urgent interim relief is asked for, the suit starts with section 12A pre institution mediation, run by the District Legal Services Authority.
