How is a trademark filed step by step from Delhi NCR?

- The Registry examiner reviews the mark and may raise an objection. If the mark clears, it moves to the Trademark Journal for a four month public opposition window.
- Once that window closes without a valid opposition, or any opposition is resolved in your favour, the Registry issues your Trademark Registration Certificate, valid for ten years.
Where does a Delhi NCR trademark application actually sit?
This is where the region works differently from what most applicants expect. The Trade Marks Registry branch that examines applications from Haryana and Uttar Pradesh is not local to either state. It sits at Dwarka, New Delhi, the same building that also houses a Patent Office branch and the sole national Copyright Office. Delhi NCT is the only part of this pipeline with all three under one roof.
The Trade Marks Registry itself is headquartered at Mumbai, with other branch offices at Kolkata, Chennai and Ahmedabad. The Dwarka branch is one office among several nationally, but it is the one that serves the whole of the NCR, regardless of which of the three states your business sits in.
What happens if your trademark faces an objection or opposition?
An objection from the examiner and an opposition from a third party are two different things, and both are handled before any application reaches a court at all.
If a dispute does escalate to litigation, which High Court hears it comes down to where your business is actually registered, and the Dwarka filing office has no say in that outcome. Only a Delhi NCT registration goes before the Delhi High Court. Register out of Gurugram or Faridabad and the matter shifts to the Punjab and Haryana High Court at Chandigarh. Register out of Noida or Ghaziabad instead, and it lands with the Allahabad High Court, whose seat is Prayagraj and which also runs a bench at Lucknow.
