A trust created in Pune has three months to apply for registration. Section 18(4)(b) of the Maharashtra Public Trusts Act 1950 starts that clock on the date of creation, not on the date the founders find the time. Applications also come back now for a newer reason. Since the 2025 amendment to section 18(6), a registration application must be accompanied by a copy of the document showing ownership over or interest in the immovable property of the trust. A file without that paper is incomplete before anyone has read your objects.
Which structure do you settle before anything is filed?
Three routes exist and only one of them is a central filing. A public trust and a charitable society both answer to the Maharashtra Public Trusts Act 1950. A Section 8 company is a Companies Act 2013 entity, filed on the MCA portal, reviewed by ROC Pune, and its CIN carries the state code MH.
One local point decides more cases here than any other. Section 2(13) of the 1950 Act defines a public trust to include a society formed for a charitable purpose and registered under the Societies Registration Act 1860. A Pune society therefore carries dual registration, and a society that stops at the 1860 Act certificate is incomplete in this state. Founders who bring a society across from elsewhere are usually surprised by that.
Pick on governance and on money. If your board is professional and your funding is corporate, the Section 8 route reads better to a donor. What documents does a Pune applicant have to put together?
Documents decide the timeline far more than the office does, so start here rather than with the form.
- The trust deed, or the memorandum and rules, with objects written to match what the organisation will actually do
- Proof of ownership over or interest in the trust's immovable property, now required alongside the section 18 application
- PAN and Aadhaar of every trustee, member or proposed director, with photographs and specimen signatures
- Address proof for the registered office, usually a leave and licence agreement, which Maharashtra makes compulsorily registrable under section 55 of the Maharashtra Rent Control Act 1999
- Seven founding members for a society, two trustees for a trust, or two directors holding a digital signature for a Section 8 company
Stamp duty on the deed depends on the instrument and its value, and we compute the exact figure before execution rather than argue about it after. Pune city registers documents through the Haveli series of Joint Sub Registrar offices, numbered Haveli No. 1 to Haveli No. 27, while Pune Rural runs its own 22 offices. A Talegaon or Chakan address therefore does not register at a Haveli counter at all.

How the filing runs from our side

Which authority takes the file, and where does it sit afterwards?
Your own working address decides this, and two addresses can decide it: the office at which the trustees carry on the administration of the trust, and the place where the trust property lies. Whichever region or sub region either of those falls in, the public trust application is presented to its Deputy or Assistant Charity Commissioner. Not the head of the organisation. Not the Joint Charity Commissioner who leads that region either. Competitor pages get this wrong often enough to be worth saying plainly.
The organisation works region wise. Pune is one of ten Joint Charity Commissioner regions and its subordinate offices are Ahilyanagar, Satara and Solapur. Your file rests with the Public Trusts Registration Office, Pune, which carries a Joint Charity Commissioner, a Deputy Charity Commissioner and three Assistant Charity Commissioners, and the portal is charity.maharashtra.gov.in. Society registration runs through the Registrar of Societies inside the same organisation, under the Law and Judiciary Department.
A Section 8 company sits somewhere else entirely. ROC Pune reviews the filing on the MCA portal, and the Regional Director for a Pune registered office is Western Region Directorate II at Navi Mumbai. Whichever route you took, the clock that matters afterwards is section 22: a change of trustees or of trust property is reported within ninety days.
What does a new Pune NGO owe in its first months?
The certificate starts a small state level stack that national guides leave out.
- A Section 8 company takes profession tax enrolment at incorporation and carries ₹2,500 a year under its own Schedule I entry, payable on or before 31 March
- Put anyone on payroll and you also need PTRC, the employer's registration certificate, with ₹200 a month deducted and ₹300 in February
- Your office is an establishment under the Maharashtra Shops and Establishments Act 2017, which names a charitable trust and an 1860 Act society in terms, and the filing is online to the Facilitator of the local area
- The Maharashtra Labour Welfare Fund takes a small half yearly contribution from both employer and employee, and we put the due dates on your compliance calendar
- Provident fund coverage begins at twenty employees and state insurance at ten persons, so a growing programme crosses one line well before the other
Count your workers before you assume registration applies. With effect from 1 October 2025 the Maharashtra threshold moved up to twenty workers, so a smaller NGO office now sends an intimation in place of a registration. Maharashtra also now caps how many trustees a trust can hold for life and sets a five year default term where the trust deed is silent, so trustee clauses copied from a 2019 template no longer hold up.
