Seven or more individuals with a shared charitable, educational, cultural, sporting or welfare purpose can register a society in Pune. A group formed to trade and divide profit among its members cannot, and neither can a body whose members are companies rather than people. Draw that line first. If your Pune group sits on the right side of it, the next question is not which form to sign. It is that Maharashtra treats your society as a public trust as well.
Society, trust or Section 8: which one do you settle on?
Settle the structure before anyone signs anything, because all three are awkward to unwind later.
A society suits a membership body with an elected governing council, such as a wholesale traders' association in Camp that has run on subscriptions for years. A trust suits a small founding group holding property for a cause, with named trustees and no elections. A Section 8 company suits founders who want institutional funding and accept annual filings with ROC Pune.
Section 2(13) of the Maharashtra Public Trusts Act 1950 settles the point. A public trust, as that provision defines it, takes in any society holding a registration under the Societies Registration Act 1860, so your Pune body is both things at once. Two registrations follow, one with the Registrar of Societies and one with the Charity Commissioner. Stop at the 1860 Act and the file is only half done. What paperwork does a Pune applicant have to put together?
Documents drive this timeline far more than the office does. Have these ready before drafting.
- A memorandum of association carrying the name, the registered office, the objects and the founding members
- Rules and regulations covering membership, the governing body, elections, meetings and how accounts are kept
- Identity and address proof for every member, with a member list showing occupation and address
- Proof of the registered office address, plus the owner's written consent where the premises are rented
- A declaration from the person who will act as president, and the affidavits your case calls for
- A copy of the document showing ownership over or interest in any immovable property of the society
That last item is newer than most guides admit. A 2025 amendment to section 18(6) of the Maharashtra Public Trusts Act requires the registration application to be accompanied by proof of the property interest, so a false claim over property cannot be made at registration.
The address proof is where Pune files stall. Groups meeting in rented rooms in Aundh, Wakad or Hadapsar usually hold the premises on a leave and licence agreement. Such agreements are compulsorily registrable in Maharashtra under section 55 of the Maharashtra Rent Control Act 1999. Register it, take the licensor's consent to the address, and that question closes.

Two costs catch Pune founders out. The first is a redraft after the office queries loose objects. The second is the payroll and profession tax registrations that arrive within weeks of the certificate.
How do the memorandum and rules become a registered society?

Which office takes the application, and where does a Pune society sit afterwards?
The competent authority for society registration is the Registrar of Societies, which sits inside the Charity Commissioner's organisation under the Law and Judiciary Department, and the service is delivered online. That organisation is built region wise, across ten Joint Charity Commissioner regions. One of them is Pune, and its subordinate offices are Ahilyanagar, Satara and Solapur. The Pune office is the Public Trusts Registration Office, Pune, staffed by a Joint Charity Commissioner, a Deputy Charity Commissioner and three Assistant Charity Commissioners.
Jurisdiction on the public trust side follows the office from which your trustees administer the trust, or else the place where the trust property lies. The file therefore reaches the Deputy or Assistant Charity Commissioner of that region or sub region. It is not the state Charity Commissioner who takes it, nor the Joint Charity Commissioner heading the region. Pages that say otherwise send readers to the wrong desk.
Then the clocks start. Registration under section 18 is applied for within three months of creation. A later change in the governing body or in the society's property is reported within ninety days, and the registering officer can extend that period on sufficient cause. Where the change touches immovable property, a further memorandum goes to the sub registrar.
What does a newly registered Pune society owe in its first months?
- The Maharashtra Shops and Establishments Act 2017 expressly names a society registered under the 1860 Act as an establishment. So the moment the society hires, a filing is due online to the Facilitator of the local area.
- That is a state Labour Department filing rather than a municipal one. You pick the validity period on the application, ten years is the outer limit, and renewal is sought no later than thirty days ahead of expiry.
- The registration threshold in Maharashtra moved up to twenty workers from 1 October 2025, and a smaller establishment lodges an intimation in place of a registration. We verify which limb applies on the date your filing goes in.
- Once there is payroll, PTRC is the employer registration that authorises the deduction, which runs at ₹200 a month with ₹300 in February.
- PTEC is the separate enrolment certificate under the Maharashtra profession tax Act of 1975, and the amount for a year falls due on or before 31 March of that year.
- Both employer and employee contribute to the Maharashtra Labour Welfare Fund twice a year, in small amounts, and the dates go onto the compliance calendar we hand you.
12A and 80G approval under the Income Tax Act are separate applications, made once the society is registered. Donors and CSR committees ask for both, so plan them into the same year.
