File nothing and the machinery still moves. Another business files the same word in your class, the Registry advertises it in the Trade Marks Journal, and the 4 month window to oppose runs whether you are watching or not. Your Pune business is then arguing prior use with old invoices instead of holding a certificate. Filing TM-A first is the cheaper move by a distance. Our fee for that is ₹1,999, and the search is done before the form goes anywhere.
What does a Pune brand lose by not filing?
Nothing visible happens on day one. The loss arrives later, and it arrives at a bad moment.
- A later filer holding a registration can get your listing pulled from a marketplace, and the platform reads the register, not your sales history.
- Without registration you are left with passing off, which means proving reputation, misrepresentation and damage before you get near a remedy.
- Buyers and investors ask for the certificate in diligence, and an application sitting on an unanswered objection reads as a live risk.
- A franchise or licensing deal needs a registered mark to license, so the brand earns nothing on its own.
The common Pune case is a business that has traded for 3 or 4 years, built a name people recognise, and filed nothing. Usually the name is still free. Sometimes it is not, and that conversation is a short one.
How long does trademark registration take, stage by stage?
The certificate is slow and the rights are not. From the day the application goes in you may use the TM symbol, and you hold a filing date, which is what decides a contest with anyone who files after you.
| Stage | What happens | Typical time |
|---|---|---|
| Search and class mapping | ipindia records checked for identical and similar marks | 1 to 2 days |
| TM-A filing | Application number issued and the TM symbol becomes available | Same day |
| Examination | The examiner issues a report and a reply is drafted | 3 to 8 months |
| Journal publication | The mark is advertised and third parties may oppose it | 4 months |
| Registration | The certificate issues where no opposition survives | 18 to 24 months |
The middle rows are government processing time and nobody sells you a shortcut through them. What you control is the first filing. A clean class description and a serious reply to the examination report is the difference between a file that closes and one that drags.
What can a trade mark cover, and what will the Registry refuse?
A word, a logo, a tagline, a label, a shape or a sound can all be registered, and each of them is filed into classes. There are 45 of them. Classes 1 to 34 are goods and 35 to 45 are services, and the class follows what you sell rather than what you call yourself.
- A Wakad apparel and lifestyle brand files garments in class 25 and its online store in class 35.
- A Hinjawadi software company files the product in class 42 and adds class 9 for a downloadable app.
- A Kothrud coaching institute files its course names in class 41.
The refusals are where the money goes. A mark that merely describes the goods, a common surname, a purely laudatory word, a bare place name, or anything already sitting on the register in the same class will draw an objection. We would rather say so during the search than after you have paid to file.
What do you have to supply for the application?
The list is short and you already hold most of it.
- The applicant's exact legal name and address, matching the incorporation record or the proprietor's identity document.
- A soft copy of the logo where the filing is a device mark.
- Form TM-48, the power of attorney, drafted by us and signed by you.
- The goods or services the mark will cover, written out class by class.
- Dated proof of first use if you are claiming prior use, meaning invoices, packaging and advertisements.
- Your Udyam registration if you hold one, because the applicant's status decides which official fee slab applies.
One Pune point on the address. Where the office is held on a leave and licence, use the address on the registered agreement, since in Maharashtra such an agreement is compulsorily registrable under section 55 of the Maharashtra Rent Control Act 1999. Keeping that address, the GST record and the application in agreement saves an argument nobody needs.
Where does a Pune application actually go, and who hears a dispute?
Filing is online at ipindia, so nobody travels to lodge a trade mark. What your address decides is which branch holds the file, and Pune has no IP office of its own.
The Trade Marks Registry office at Mumbai serves Maharashtra, Madhya Pradesh, Chhattisgarh and Goa. Read the jurisdiction rule once and the reason is obvious. Territorial jurisdiction turns on the applicant's principal place of business in India, and only where no such place exists does the Registry fall back on the address for service given in the application. Your Pune registered office is therefore what fixes the branch, not the spread of your customers. ipindia calls all five offices branch offices and names none of them a head office.
The map is not the same for every right, which catches people who assume one office does everything. A Maharashtra patent application goes to the Patent Office at Mumbai. Gujarat splits, with patents to that same office and trade marks to Ahmedabad. Copyright sits with the office at New Delhi wherever you are, so the artwork inside a logo is a separate filing.
Enforcement comes back to Pune. An infringement suit that clears the specified value is a commercial dispute, and Maharashtra has set that value for the whole State at ₹50,00,000, well above the floor national pages tend to quote. Sue for up to and including ₹1 crore and your Commercial Court is the senior most Civil Judge, Senior Division. Claim above ₹1 crore and the file belongs to the Court of District Judge-2. Unless urgent interim relief is genuinely sought, section 12A puts the matter through pre institution mediation at the District Legal Services Authority before any plaint. Over Pune the Bombay High Court is appellate and supervisory.
How do we file your mark and follow it through?
- We take the mark, the goods list and the address, then run the ipindia search and show you the near misses.
- We map the classes against what you actually sell, and say plainly where the mark looks weak.
- We file TM-A with Form TM-48, send you the application number, and you use the TM symbol from that day.
- We draft the reply when the examination report arrives, file it, and attend the hearing if one is fixed.
- We watch the journal through the 4 month window and tell you the day the certificate is issued.
How are Pune businesses using trade marks?
- A consumer brand in Wakad, inside PCMC limits, filing the house mark in class 25 and its store in class 35 before a marketplace takedown forces the question.
- A trust founder in Shivajinagar registering the programme name and logo, so a donor facing identity is not picked up by an unrelated group.
- A Hinjawadi software company adding class 42 once its product name starts appearing in enterprise contracts and tender documents.
Where do most trade mark files stall, and who catches yours?
The examination report is where most trade mark files stall, and here the person who drafts that reply is the person who filed the mark 6 months earlier. Before any of it, you get a search report while the mark can still be changed, a class map built from what you actually sell, and nobody inventing an IP office in the city. Our fee for the filing is ₹1,999. For the national picture, read how trademark registration works across India, then send the address, the logo file and the goods list. A callback within 30 minutes is usually enough to get the search moving, and everything after that runs online. LegalX India's Pune office is at Yashwant Nagar, Near Bharatiya Samajseva, Yerwada, Pune 411006, though no part of a TM-A filing needs you in the room. More than 15,000 businesses have used LegalX India, with 50+ CA and CS professionals behind the work.
