Find the registration certificate before anything else. It carries the registration number, the classes, the date of registration and the address for service that the register still holds for you. Those four details decide whether a renewal is a three day job or a scramble. A Pune business that shifted from Shivajinagar to Kharadi four years ago and never told the register is the one that misses its own expiry date, because every letter goes to an office nobody sits in any more. We read the certificate first, then match it against the live entry on ipindia.
What does a Pune brand lose when the renewal slips?
A registered mark runs for 10 years and then stops running. Nothing in the system carries it on for you. Once the term is up and no TM-R has gone in, the exclusivity that let you write to a copycat and be taken seriously is gone, and the mark can be struck off the register.
The loss is rarely abstract. A trust in Shivajinagar that has run one programme under one name for a decade finds the name is now anybody's to use. A component manufacturer at Chakan that stamps the mark on every carton loses the document that made its infringement notice land. Fresh registration is no substitute. It puts you at the back of the queue, behind whoever filed in the gap, and the examiner reads your own lapsed mark as part of the record.
How does a renewal run, stage by stage?
The filing itself is short. What decides the calendar is the day you start.
| Stage | What happens | When |
|---|---|---|
| Renewal window opens | The TM-R can go in once the mark is inside its final months | Up to 6 months before expiry |
| Certificate and register check | We read the certificate and pull the live entry, class by class | Day 1 |
| TM-R filed on ipindia | Particulars, authorisation and fees go in electronically | 3 to 5 days |
| Renewal recorded | The register carries the mark forward for another 10 years | Registry timeline |
| Late filing window | Filing stays open after expiry, on payment of the surcharge | Up to 6 months after expiry |
That 6 month cushion in the first row is the only comfortable place to stand. Owners who reach us inside it get a quiet filing. Owners who reach us after the date get a working one, with a surcharge and far less room if the record needs correcting first.
What does a renewal carry forward, and what does it not?
Renewal continues the mark exactly as the register holds it. Same mark, same specification, same classes, another 10 years. It is not the moment to widen the goods and services, redraw the logo or add the class you should have taken at the start. Each of those is a fresh application, examined on its own merits against everything filed since.
Renewal does not repair the record either. If ownership moved when a proprietorship became a private limited company, that is an assignment and it goes on record separately. If the address for service belongs to premises you left two moves ago, that is its own request. We raise both before the TM-R goes in, because a renewal filed against a stale owner name is a renewal you spend a year explaining.
What do you have to send us before the TM-R goes in?
- The registration certificate, or the registration number alone if the certificate is mislaid
- Every class the mark is registered in, and whether each one is still in use
- The principal place of business in India, with the Pune address you actually work from, whether that is Baner or a unit at Chakan inside a MIDC notified industrial area
- The name standing on the register today, and any change of name, assignment or merger since registration
- A signed authorisation so we can file the TM-R on your behalf
Most Pune owners send that in one email. If a second mark or a second class turns up against the same address, we tell you before you pay for one.
Where does a Pune renewal land, and who hears a fight over the mark?
Filing is online at ipindia and nobody travels for it. The office still matters for hearings, oppositions and correspondence. The Trade Marks Registry office at Mumbai serves Maharashtra, Madhya Pradesh, Chhattisgarh and Goa, so that is the office a Pune owner deals with. The allocation is not a choice you make. The territorial jurisdiction of the Trade Marks Registry is determined on the basis of the principal place of business of the applicant in India, which is exactly why the address on your entry earns its keep. Pune itself has no IP office, so treat any offer of a local one with suspicion.
A fight over the mark sits somewhere else again. In Maharashtra the pecuniary value specified under the Commercial Courts Act is ₹50,00,000. Cross that figure and an infringement suit becomes a commercial dispute, heard by the Commercial Court at Pune. Unless urgent interim relief is asked for, the plaintiff first exhausts pre institution mediation through the District Legal Services Authority. An appeal from a Commercial Court below District Judge level goes to the Commercial Appellate Court, which Maharashtra has designated as the Court of District Judge-1. Writ petitions out of Pune district are heard at the principal seat of the Bombay High Court.
How we file the TM-R and follow it through
- We pull the live entry for every mark held at your Pune address, so a second class registration is not quietly left behind.
- We check owner name, address for service and principal place of business against the register, and list anything that needs its own request.
- We prepare the TM-R, take your confirmation on the particulars, and file it with the fees through ipindia.
- We send the filing receipt the same day and track the entry until the renewal shows against the mark.
- We hand you the next expiry date in writing, with a reminder set 6 months ahead of it.
Which Pune owners are renewing right now?
- A trust in Shivajinagar renews the name its education programme has carried for 10 years, and finds that only one of its two classes was renewed at the last cycle
- A component manufacturer at Chakan renews the word mark on its packaging and corrects the address for service after the unit moved to a larger shed
- A founder who turned a proprietorship into a private limited company renews only once the assignment is on record, so the certificate and the register finally say the same thing
- A Pune exporter renews early because a distributor abroad asked for a certificate that is current on its face
What makes a renewal fail, and how do we stop it?
Renewal is a small filing carrying a large consequence, and it fails for administrative reasons: an old address, a forgotten class, an owner name that changed three years ago. Our CA and CS team reads the register before it reads your calendar. Trademark Renewal in Pune starts at ₹2,499, and we file within 3 to 5 days of getting your papers. The work runs online from end to end, and our Pune office at Yashwant Nagar, Near Bharatiya Samajseva, Yerwada, Pune 411006 is for owners who would rather hand the certificate across a desk than scan it. Ask for a callback and one reaches you within 30 minutes. We have handled work for 15,000+ customers at a 4.8 Google rating.
