The document that decides a Pune trust registration is rarely the one founders worry about. It is the paper proving the trust's interest in its immovable property. A 2025 amendment rewrote section 18(6). Your application now has to arrive with a copy of whatever evidences ownership over, or interest in, the trust's immovable property. The stated purpose is to stop a false claim over property being made at the registration stage. Bring a weak title paper and the file stalls before anyone reads your objects clause. Bring a clean one and the rest is drafting, duty and sequencing.
Which structure do you settle before a word is drafted?
Three vehicles do charitable work in this state and they are not interchangeable.
- A public trust under the Maharashtra Public Trusts Act 1950, constituted by a deed and registered with the Deputy or Assistant Charity Commissioner for your region.
- A society under the Societies Registration Act 1860, which here carries a second registration on top of the first.
- A section 8 company under the Companies Act 2013, which answers to ROC Pune and files on the MCA portal instead.
The middle one is where Pune founders get caught. Section 2(13) defines a public trust to include a society formed either for a religious or charitable purpose or for both and registered under the Societies Registration Act, 1860. So a Pune NGO built as a society is also a public trust. A society that stops at the 1860 Act registration is incomplete here. The same organisation handles both jobs, because the Registrar of Societies sits inside the Charity Commissioner machinery under the Law and Judiciary Department, with delivery online.
What does a Pune applicant have to put together?
Paperwork comes before the appointment, not after it. The deed carries the trust name, the objects, the first trustees, the class of beneficiary and the powers your trustees will actually use. Identity and address papers follow for the settlor and for every trustee, each with a signed consent to act. Then the address itself: the premises the trust will administer from, whether that is a rented room in Camp or a school building at Hadapsar, with the owner's no objection where the premises are held on licence.
Start the property document early, because section 18(6) has turned it into an admission requirement rather than a courtesy. Trustee clauses need the same attention. Maharashtra now caps how many trustees a trust can hold for life and sets a five year default term where the trust deed is silent, and we check the current position before we draft your trust deed.

Which instrument your deed is, and what value you settle on the trust, together fix the Maharashtra duty. We work the exact figure out before execution. Duty is paid electronically through GRAS, the Government Receipt Accounting System that section 10(3) of the Maharashtra Stamp Act 1958 names as a permitted mode, or through the e-SBTR route. A flat percentage for a trust deed is guesswork, because Schedule I was amended in 2025 and what you settle on the trust moves the number.
Which comes first, the deed or the section 18 application?

- Duty is computed and paid through GRAS, and the deed is executed and registered at the sub registrar office serving your address. Pune City uses a numbered Haveli series of Joint Sub Registrar offices and Pune Rural has its own set, so the address decides the office, not the city name.
- The section 18 application goes to the Deputy or Assistant Charity Commissioner for your region, with the property document and the trustee consents.
- Once the entry is made in the Register of Public Trusts we move to PAN, the bank account and the 12A and 80G applications.

Which office receives the application, and where does a Pune trust sit afterwards?
The Charity Commissioner organisation runs region wise. The Charity Commissioner, Maharashtra State sits at the top, and under that are ten Joint Charity Commissioner regions, one of which is Pune, with subordinate offices at Ahilyanagar, Satara and Solapur. The Pune office is the Public Trusts Registration Office, Pune, staffed by a Joint Charity Commissioner, a Deputy Charity Commissioner and three Assistant Charity Commissioners. Filings and status run through charity.maharashtra.gov.in.
The application does not go to the head of the region. It goes to the Deputy or Assistant Charity Commissioner of the region or sub region within whose limits the trustee has an office for the administration of the trust or the trust property is situated. That is why the administering address decides your office, and not where your donors or your volunteers happen to sit.
Afterwards the trust lives on the Register of Public Trusts. A new trustee, a retirement, an amended deed or a property movement is reported by a change report under section 22, within ninety days of the change. Sufficient cause lets the registering officer extend that window. Immovable property in the change pulls in one more document, a prescribed memorandum for the sub registrar. What does a new Pune trust owe in its first months?
The statutory clock starts at creation, not at your first board meeting. A trust created after the Act came into force must apply for registration within three months of its creation. Miss that and you are explaining a delay instead of filing a clean application.
The labour side is the one that surprises people. The Maharashtra Shops and Establishments Act 2017 defines establishment widely, and the definition names a charitable or other trust and a society registered under the Societies Registration Act 1860 in terms. So a trust working out of an office at Aundh or Kalyani Nagar is an establishment even though it sells nothing at all. Registration is online to the Facilitator of the local area, within sixty days of the establishment commencing business, and the Facilitator issues the certificate online with a Labour Identification Number. No fee is prescribed, only the electronic transaction charges. You ask for the term you want, up to a ten year maximum, and the certificate runs for exactly that. The renewal application has to be in no later than thirty days before it expires.
From 1 October 2025 the registration threshold in Maharashtra stands at twenty workers. A smaller establishment files an intimation and no certificate is issued to it at all. On the day your file goes in, we check which of the two you fall under.
Payroll brings its own set. A trust that pays salaries needs PTRC, the employer's certificate of registration, and deducts ₹200 a month from a salary above the slab threshold, with ₹300 in February. Whether the trust also carries PTEC turns on which Schedule I entry catches it, and we check that against the activity rather than assuming. Employer and employee each pay a small contribution to the Maharashtra Labour Welfare Fund twice a year. Both of those dates go on your calendar.
